التزامات الصائن فی عقد الصیانة دراسة مقارنة

الملخص
یعد عقد الصیانة الذی یرتب التزامات على عاتق الصائن واحد من اهم العقود فی الحیاة الیومیة فهو عقد مستحدث مستقل له خصائصه وصوره الخاصة به ولما کانت الآلات والاعیان لها دور مهم فی حیاة الانسان فان الالتزام بصیانة تلک الاعیان یعد امرا ضروریا من اجل ادامتها وصیانتها واعادتها إلى حالتها المعهودة التی کانت علیها من قبل حصور الاعطال فیها فکان لنا ان نتناول تلک الالتزامات الملقاة على عاتق الصائن بشیء من التفصیل مبتعدین عن الاجالة والحشو معتمدین على اسلوب المقارنة واقتراح نصوص قانونیة من اجل تنظیم تلک المسالة بشیء من التفصیل خاصة بعد غیاب التنظیم القانونی الخاص بتلک المسألة فیوجب على الصائن بعد صیانة تلک الاعیان المتعاقد علیها وانجاز تلک الاعمال حسب ما هو متفق علیه فی العقد ما بین الطرفین والتزامه بالمحافظة على تلک الاعیان طیلة فترة الصیانة وان یتوخى الحیطة والحذر عند القیام بالاعمال المکلف بها
